Updated Safety Regulations in force from 01/10/2022
The Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022 will come into force on 01/10/2022, extending the Smoke and Carbon Monoxide Alarm (England) Regulations 2015. The updated Regulations are coming into force without any transition period and must be complied with immediately.
At the moment the Regulations are that:
1. A smoke alarm must be installed on every story of the property used for living accommodation.
2. A carbon monoxide alarm must be installed in any room used as living accommodation where solid fuel is used.
3. All alarms must be tested on the first day of the tenancy, ideally in the presence of the tenants, with a written record kept.
From 01/10/2022 the Regulations will be updated as follows:
1. Carbon monoxide alarms must be fitted in private rented properties with fixed appliances such as gas boilers or fires and whenever new appliances (such as gas boilers or fires) are installed in any home.
2. The carbon monoxide alarms can be battery operated only, i.e., do not need to be wired in.
3. Landlords must repair or replace faulty smoke and carbon monoxide alarms, at their own cost.
In addition, local authorities will have enforcement powers to fine landlords in breach of the Regulations up to £5,000.
To ensure they are fully aware, government has provided a useful Guidance document with Q&A for the most common situations, which landlords are urged to familiarise themselves with.
